  • Survivor and Other Death Benefits A pension plan is required by law to provide the Qualified Joint and Survivor Annuity (QJSA) and the Qualified Preretirement Survivor Annuity (QPSA) death benefits to vested, married participants.
  • The cost for this coverage may be, but need not be, passed on to the participant.
  • A participant may waive this coverage, and the associated cost, but spousal consent is necessary.
  • Written notice to the participant of these rules is generally required.
  • A plan may, and often does, provide more generous death benefits than is required.
  • Usually, actuarial calculations are required to determine the death benefit payable.

This service evaluates the calculation of death benefits payable to the surviving spouse, beneficiary, heirs, or estate from the qualified or nonqualified pension plan due to the death of the participant before or after retirement.  In many cases, participants and their beneficiaries, whether widows, heirs, or the estate are unaware of the survivor benefits available to them, some of which are mandated by ERISA survivor benefit laws.  In addition, a period of disability frequently precedes death, complicating the calculation of the death benefit.  Contact us now!
